Welcome to IcyPages.com (“IcyPages,” “we,” “us,” or “our”), operated by Tribe 1 Technologies LLC, a Missouri limited liability company. By accessing or using our website, services, or any content provided through IcyPages.com (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Service.

IcyPages is an adult-oriented subscription-based content platform intended for users aged 18 years or older. The Service features content that may include explicit material, and access is strictly prohibited for minors. By using the Service, you represent and warrant that you are at least 18 years of age (or the age of majority in your jurisdiction, if higher) and that you have the legal capacity to enter into these Terms.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Tribe 1 Technologies LLC. We may update these Terms at any time, and your continued use of the Service after such changes constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

2. User Accounts and Eligibility

Account Creation: To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Age Restriction: The Service is strictly for users 18 years of age or older. You must verify your age during signup. We reserve the right to request proof of age at any time. If we determine you are under 18, your account will be terminated immediately.
Free and Premium Access: Upon signup, you are automatically assigned a “Free” subscriber role, granting limited access (e.g., blurred previews and following creators). Premium Access requires a subscription fee and unlocks full content from followed creators.
Prohibited Users: You may not use the Service if you are barred from doing so under applicable laws, including U.S. export controls or sanctions.

3. Content and Usage

Platform Content: All content on IcyPages, including posts, images, videos, and profiles, is provided by us or our affiliates. Content may include adult-oriented material. We apply security measures such as blurring for non-Premium views, watermarks on images, and restrictions on saving or right-clicking.
User Conduct: You agree not to:
- Use the Service for any illegal purpose or in violation of any law.
- Attempt to circumvent security features, such as by screenshotting, downloading, or sharing protected content.
- Harass, threaten, or impersonate others.
- Upload or transmit viruses, malware, or harmful code.
- Engage in commercial activities without our consent.
Following Creators: You may follow creator profiles to customize your feed. Feeds display content chronologically from followed creators only.
2257 Compliance: In compliance with 18 U.S.C. § 2257, all visual depictions of actual sexually explicit conduct on the Service are produced in accordance with record-keeping requirements. Custodian of Records: Tribe 1 Technologies LLC, St. Louis, MO 63122. All depictions are fictional and do not involve actual individuals; records are maintained solely for legal compliance.

4. Subscriptions and Payments

Subscription Tiers:
- Free Access: No cost; limited to previews and basic features.
- Premium Access: $9.99 per month (or as otherwise specified per creator), granting full access to content from that creator. Subscriptions are per-creator and do not provide access to all creators.
Billing: Payments are processed through CCBill, our third-party payment processor. By subscribing, you authorize recurring charges to your payment method until cancellation. Prices may vary by creator in the future, and pay-per-post options may be added. We do not store full payment details; all sensitive info is tokenized and managed by CCBill per PCI DSS standards.
CCBill Requirements: In accordance with CCBill’s policies for high-risk merchants, all transactions are subject to their terms (available at ccbill.com). We may use alternative processors if needed, with notice provided.
Refunds and Cancellations: Subscriptions are non-refundable except as required by law. You may cancel anytime via your account settings; access continues until the end of the billing period, after which you downgrade to Free. We reserve the right to suspend or terminate subscriptions for violations.
Taxes: You are responsible for any applicable taxes on your purchases.

5. Intellectual Property

All content, trademarks, and materials on the Service are owned by Tribe 1 Technologies LLC or our licensors. You are granted a limited, non-exclusive, non-transferable license to access content for personal use only, subject to your subscription level.
You may not reproduce, distribute, modify, or create derivative works from any content without our written consent. Watermarked images and protected media are not to be shared or repurposed.

6. Termination

We may suspend or terminate your account and access to the Service at any time, without notice, for reasons including but not limited to violations of these Terms, suspected fraud, or legal requirements. Upon termination, all licenses and rights granted to you cease.

7. Disclaimers and Limitations of Liability

Disclaimers: The Service is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We do not guarantee uninterrupted access or error-free operation.
Limitations: To the fullest extent permitted by law, Tribe 1 Technologies LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, even if advised of the possibility. Our total liability shall not exceed the amount you paid us in the preceding 12 months.
Indemnification: You agree to indemnify and hold us harmless from any claims arising from your use of the Service or violation of these Terms.

8. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Missouri, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Missouri. You waive any objection to venue or jurisdiction.

9. Miscellaneous

Severability: If any provision is held invalid, the remainder remains in effect.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement.
